Personal Injury & Products Liability
The firm’s attorneys have been instrumental in a number of successful cases involving personal injury and products liability actions. They have recovered in excess of $8.3 million for clients in these types of cases. Illustrative personal injury cases include representation of minor children against entities trusted with their care who negligently allowed them to be sexually abused, claims for wrongful death against the former owner of a plant leaving the premises in a dangerous condition when the plant was sold, and cases involving chemical exposure to industrial workers. The firm’s attorneys have also worked on a number of substantial products liability cases. These include the Alabama Supreme Court’s decision in Hill Mfg. Co. v. Webb, 724 So. 2d 1137 (Ala. 1998), which arose out of an industrial accident involving chemical burns and concluded with a $900,000 verdict for the client in the Circuit Court of Winston County, Alabama. To date this verdict is the largest verdict out of Winston County affirmed by the Alabama Supreme Court. In the Webb case, products liability claims were stated for defective warnings on the chemical sewer solvent used by the client in his job as a maintenance person. Other products liability cases resulting in confidential settlements have been brought against an automobile manufacturer for defective seatbelts, the manufacturer of commercial drilling rigs, and the manufacturer of a morphine pain pump used in hospitals and other settings.
